This afternoon Slate magazine posted an interesting (and quite telling) calculator that allows you to enter your annual income for 2010 and see how long it took Mitt Romney to earn that amount in 2010, and vice versa (how long it would take you to earn his amount of income).

Sued by a creditor?

During the last year and a half it seems that the number of lawsuits filed by creditors against consumers in order to try and collect a debt is staggering.

I have defended a number of these types of suits, and read many more, and much like the faulty mortgage foreclosure lawsuits, these credit lawsuits are often flawed, sometimes fatally flawed.

So what does this mean for you?

First, read the suit.  Do you recognize the name of the person/company suing you? Do you recognize the alleged debt they claim?  Have you ever done business with them? Are you the same person that they claim to be suing (i.e. same or similar name, but you are not the right person)?

Then, do you have proof of payment? Have you discharged that debt already in bankruptcy?

And finally, are you prepared to defend yourself? Most lawsuits have an answer date approximately three weeks in the future and you do not have a lot of time to mull over this…you need to consult with a veteran attorney soon and go over your options.
